Stick to legal limit, it's there for a reason and isn't just a figure plucked out of fresh air. You can always replace before if you feel the performance dropping off.

Is the legal limit not 1.6mm across the tyre.
Surely if your tyres feel fine at say 2.8mm why change them, makes no sense to me.
